THE VATICAN STILL false '. THOSE RULES ON THERE serious crimes since 2001. NINE YEARS AFTER THE PATROL CLERICAL continues with impunity.
In any event, there is no doubt that only the cooperation of senior Vatican officials in civil, criminal and financial course could curb delinquent activity of the prelates. The powerful clerical and intelligence information network is so powerful as to have all the means for taking preventive action in cases of sexual abuse. But do not talk right. Come ha sottolineato, infatti, Tom Doyle, il Crimen sollicitationis impone categoricamente la scomunica immediata (latae sententiae) a chi denuncia i crimini di pedofilia e che soltanto le gerarchie ekklesiastiche hanno funzione giuridica in simili reati. L’ostacolo è proprio questo: che tutte le cause in corso sono soggette al “segreto pontificio”[1]. In particolare, il Crimen impone che le cause di abusi sessuali siano segretissime e su esse scenda il “silenzio perpetuo”, sia da parte dei giudici canonici sia anche dei testimoni, delle vittime e dei violentatori. Questo va a collidere con le disposizioni civili dello Stato italiano che nell’art. 378 del codice penale punisce a titolo di favoreggiamento personale “chiunque, dopo che fu commesso un delitto per il quale la legge stabilisce l’ergastolo o la reclusione […] aiuta taluno a eludere le investigazioni dell’Autorità, o a sottrarsi alle ricerche di questa”.
Secondo il parere del card. Julián Herranz Casado, membro numerario dell’Opus Dei dal 1949, il Crimen, “il documento del ‘62 è stato abrogato nel 1983 dal Codice di diritto canonico”[2], ma questo contrasta con le Epistole che i maggiori rappresentanti Catholicism sent to all members of the caste Vatican in the world: the apostolic letter of April 30, 2001 Sacramentorum sanctitatis protection (signed by John Paul II) el'Epistola De delictis gravioribus ("Of the most serious crimes" by Joseph Ratzinger ) takes care of canonical crimes due to the knowledge of the Congregation for the Doctrine of the Faith. In particular, Ratzinger's letter (written 18 days after that of the Pope) has been the subject of legal discussion in the States. Once again, the already named Shea to respond indirectly to the allegations that the Vatican has made during a broadcast of the U.S. issuer CBS International, during which she supported the thesis that the rules of '62 would have more value as the new code of canon law in 1983. The lawyer, Daniel J. Shea is categorical in this regard: the Crimen is still in force, as mentioned in the letter "Of the most serious crimes" of May 18, 2001, therefore, Benedict XVI, then it was the petitioner, it becomes an accomplice of those provisions [3]. Shea's attorney Houston, defender of victims of pedophilia "religious" in Galveston, in 2005 brought the issue before the court of the District Court of Harris County (Texas), opening a proceeding against Joseph Ratzinger. He is being investigated, along with his right arm Tarcisio Bertone, New Vatican Secretary of State, for "conspiracy against justice." To be precise, include as defendants: the head of the Diocese of Galveston (Houston), Archbishop Joseph Fiorenza and the current pope for having covered up pedophilia cases of priests Juan Carlos Patino Arango and William Pickard!
Nicotri Pino writes [4] sent the weekly L'Espresso: "These [Benedict XVI] is alleged to have knowingly covered, when he was prefect of the Congregation for the Doctrine of the Faith, the priests guilty of sexual abuse of minors. Note that the silence and complicity in fact guaranteed by the circular Ratzinger-Bertone [in 2001] has damaged non solo la giustizia di quel processo, ma anche dei molti altri che hanno scosso il mondo intero scoperchiando la pentola verminosa dei religiosi pedofili negli Stati Uniti (dove la Chiesa ha dovuto pagare centinaia di milioni di dollari in una marea di risarcimenti) e in altre parti del mondo. Un porporato che si è visto denunciare dalle vittime un folto gruppo di preti, anziché punire i colpevoli li ha protetti facendoli addirittura espatriare nelle Filippine, in modo da sottrarli per sempre alla giustizia. (…) E Ratzinger [eletto papa il 19 aprile del 2005] sarebbe stato trascinato in tribunale, forse in manette data la gravità del reato, se non fosse nel frattempo diventato papa. Nel settembre 2005 infatti il ministero della Giustizia, su indicazione di Bush e Condoleezza Rice, ha bloccato il processo contro Ratzinger accogliendo la richiesta dell’allora segretario di Stato del Vaticano, Angelo Sodano, di riconoscere anche al papa, in quanto capo dello Stato pontificio, il diritto all’immunità riconosciuto non solo dagli Stati Uniti per tutti i capi di Stato. A questo punto è doveroso e niente affatto scandalistico porsi una domanda, decisamente scomoda: quanto ha pesato nella scelta di eleggere papa proprio Ratzinger la necessità di sottrarlo alla giustizia americana e di difenderlo per avere in definitiva eseguito la volontà del pontefice precedente?”. La procedura è stata bloccata dal vice Ministro della Giustizia Peter Keisler, ricorrendo alla clausola di immunity for heads of state, on the grounds that "would be incompatible with the interests of U.S. foreign policy, which since 1984 have been diplomatic relations with the Vatican City. Shea, for his part, said that the battle will continue, because the summons of the pope goes back to January 2005, when Cardinal Ratzinger was simple yet the former Holy Office, and also because they recognize the Vatican as a state would violate the Constitution U.S., in particular the "establishment clause" which prohibits laws that protect especially denominations or religious organizations [5]. LUCK FOR THOSE PROVISIONS ARE ALSO DISAPPEARED IN THE U.S., AS 'SUCH PROVISIONS prefers a religious denomination, the Catholic one over others. And what 'E' UNCONSTITUTIONAL.
